What makes Wyoming different

Wyoming assigns unpaid-wage enforcement to the Labor Standards program within the Department of Workforce Services. Its administrative rules provide for a signed written or electronic claim alleging wages owed under Wyoming wage statutes. Labor Standards serves the claim on the employer, and the employer generally has 10 days from the agency letter to answer; the program can investigate and order payment where liability is established. The rules define compensation broadly enough to include pay, salary, bonuses and commissions, while fringe-benefit disputes can turn on the employer's agreement or policy. This gives Wyoming workers a specific state claim route even though the federal minimum wage applies to most employment and the state does not impose a blanket PTO cash-out rule. For a final-pay dispute, keep the separation notice, final timesheet, commission terms and written vacation policy so the agency can distinguish earned compensation from a benefit the policy never promised to pay.

Before filing with Wyoming Labor Standards

Wyoming's Department of Workforce Services says its wage-claim process is for work performed in Wyoming and asks the worker to try resolving the shortage with the employer first. Filing the state form authorizes Labor Standards to investigate and attempt collection, including a possible partial settlement. That makes the chronology important: keep the written request to the employer, the employer's response, time and pay records, and any commission or vacation agreement. A worker whose job was performed outside Wyoming should not assume that the Wyoming form is the correct route merely because the employer is based there. The agency's form and instructions should be checked before sending sensitive payroll documents.

Is PTO payout required by law in Wyoming?

It depends on your employer's written policy. Wyoming has no blanket state law requiring PTO payout, but if your employer's policy or employment contract provides for it, the payout is enforceable as wages. Accrued vacation must be paid unless a written forfeiture policy was provided and acknowledged.

How long does my employer have to pay my final paycheck in Wyoming?

In Wyoming, the deadlines differ based on how your employment ended. If you were terminated by your employer, your final paycheck is due next regular payday. If you resigned voluntarily, the deadline is next regular payday. If your employer misses these deadlines, you can file a wage claim with the Wyoming Department of Labor.

What is the minimum wage in Wyoming in 2026?

Wyoming's minimum wage is currently $7.25/hr (federal minimum). State minimum is $5.15/hr, but federal minimum of $7.25 applies to most employers That's the statewide floor — a handful of localities within Wyoming set their own higher minimum, so confirm the current figure with the Wyoming Department of Labor.

What can I do if my employer doesn't pay my final paycheck on time in Wyoming?

A late or missing final paycheck in Wyoming is grounds for a formal wage claim with the state's labor enforcement agency, and depending on the circumstances you may recover penalties or interest on top of the unpaid wages. A civil suit or a complaint to the federal Wage and Hour Division are also options if federal law covers your employer. Keep pay stubs, timesheets, and any written communication as evidence.

Does Wyoming require employers to include accrued sick leave in the final paycheck?

Usually no — sick leave and vacation are treated as different buckets under Wyoming PTO rules, unless your employer merges them into one combined PTO bank or your employment agreement says sick time vests as wages. Review your handbook to see which setup you have.
